  • WARRANTY

    IMPORTANT: BY USING OUR PRODUCTS YOU ARE AGREEING TO BE BOUND BY THE TERMS OF OUR ONE (1) YEAR WARRANTY AS SET OUT BELOW. DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY.

    WHAT IS COVERED BY THIS WARRANTY?

    Sky-Watch A/S warrants our products and accessories contained in the original packaging against defects in materials and workmanship when used normally in accordance with Sky-Watch’s published guidelines for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser (“Warranty Period”). Sky-Watch’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications.

    WHAT IS NOT COVERED BY THIS WARRANTY?

    This Warranty does not apply to any non-Sky-Watch products or any software, even if packaged or sold with Sky-Watch hardware. Manufacturers, suppliers, or publishers, other than Sky-Watch, may provide their own warranties to you – please contact them for further information. Software distributed by Sky-Watch without the Sky-Watch brand (including, but not limited to system software) is not covered by this Warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. Sky-Watch does not warrant that the operation of the Sky-Watch Product will be uninterrupted or error-free. Sky-Watch is not responsible for damage arising from failure to follow instructions relating to the Sky-Watch Product’s use.

    This Warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by use with a third party component or product that does not meet the Sky-Watch Product’s specifications under the technical specifications for each product; (d) to damage caused by accident, abuse, misuse, fire, earthquake or other external cause; (e) to damage caused by operating the Sky-Watch Product outside Sky-Watch’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Sky-Watch or Authorized Service Provider (“AASP”); (g) to an Sky-Watch Product that has been modified to alter functionality or capability without the written permission of Sky-Watch; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Sky-Watch Product; (i) if any serial number has been removed or defaced from the Sky-Watch Product; or (j) if Sky-Watch receives information from relevant public authorities that the product has been stolen or other security measures designed to prevent unauthorized access to the Sky-Watch Product, and you cannot prove in any way that you are the authorized user of the product (eg. by presenting proof of purchase).

    YOUR RESPONSIBILITIES

    YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE INFORMATION CONTAINED ON THE SKY-WATCH PRODUCT TO PROTECT THE CONTENTS AND AS A PRECAUTION AGAINST POSSIBLE OPERATIONAL FAILURES.

    Before receiving warranty service, Sky-Watch may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow Sky-Watch’s procedures for obtaining warranty service. Before submitting your Sky-Watch Product for warranty service you should maintain a separate backup copy of the contents of its storage media, remove all personal information that you want to protect.

    DURING WARRANTY SERVICE THE CONTENTS OF THE STORAGE MEDIA WILL BE DELETED AND REFORMATTED. SKY-WATCH IS NOT RESPONSIBLE FOR ANY LOSS OF SOFTWARE PROGRAMS, DATA OR OTHER INFORMATION CONTAINED ON THE STORAGE MEDIA OR ANY OTHER PART OF THE SKY-WATCH PRODUCT SERVICED.

    Following warranty service your Sky-Watch Product will be returned to you as your Sky-Watch Product was configured when originally purchased, subject to applicable updates. Sky-Watch may install system software updates as part of warranty service that will prevent the Sky-Watch Product from reverting to an earlier version of the system software. Third party applications installed on the Sky-Watch Product may not be compatible or work with the Sky-Watch Product as a result of the system software update. You will be responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this Warranty.

    Important: Do not open the Sky-Watch Product. Opening the Sky-Watch Product may cause damage that is not covered by this Warranty. Only Sky-Watch or an AASP should perform service on Sky-Watch Products.

    WHAT WILL SKY-WATCH DO IN THE EVENT THE WARRANTY IS BREACHED?

    If during the Warranty Period you submit a claim to Sky-Watch or an AASP in accordance with this warranty, Sky-Watch will, at its option:

    (i) repair the Sky-Watch Product using new or previously used parts that are equivalent to new in performance and reliability,

    (ii) replace the Sky-Watch Product with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability, or

    (iii) exchange the Sky-Watch Product for a refund of your purchase price.

    Sky-Watch may request that you replace certain user-installable parts or Sky-Watch Products. A replacement part or Sky-Watch Product, including a user-installable part that has been installed in accordance with instructions provided by Sky-Watch, assumes the remaining term of the Warranty or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When an Sky-Watch Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Sky-Watch`s property.

    HOW TO OBTAIN WARRANTY SERVICE?

    Please access and review the online help resources described below before seeking warranty service. If the Sky-Watch Product is still not functioning properly after making use of these resources, please contact an Sky-Watch representative or, if applicable, an Sky-Watch AASP, using the information provided below. An Sky-Watch representative or AASP will help determine whether your Sky-Watch Product requires service and, if it does, will inform you how Sky-Watch will provide it. When contacting Sky-Watch via telephone, other charges may apply depending on your location.

    WARRANTY SERVICE OPTIONS

    Sky-Watch will provide warranty service through one or more of the following options:

    (i) Mail-in service. If Sky-Watch determines that your Sky-Watch Product is eligible for mail-in service, Sky-Watch will send you prepaid waybills and if applicable, packaging material and instructions on how to properly pack and address your Sky-Watch product, so that you may ship your Sky-Watch Product to the correct location. Instructions may be sent to you via email or in hard copy with the packaging material. Once service is complete Sky-Watch will return the Sky-Watch Product to you. Sky-Watch will pay for shipping to and from your location if all instructions regarding the method of packaging and shipping the Sky-Watch Product are followed.

    LIMITATION OF LIABILITY

    EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKY-WATCH IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE SKY-WATCH PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE SKY-WATCH PRODUCT.

    THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. SKY-WATCH DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY SKY-WATCH PRODUCT UNDER THIS WARRANTY OR REPLACE THE SKY-WATCH PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN THE SKY-WATCH PRODUCT.

    SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

    GENERAL

    No Sky-Watch reseller, agent, or employee is authorized to make any modification, extension, or addition to this Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This Warranty is governed by and construed under the laws of the country in which the Sky-Watch Product purchase took place. Sky-Watch or its successor in title is the warrantor under this Warranty.

    To extend your coverage with further two years, you can purchase the Sky-Watch Care+.

    Sky-Watch Care+ is a comprehensive protection plan that extends the standard service coverage of your Sky-Watch product. This affordable plan gives greater peace of mind. During the warranty period, whenever you have a problem you can take your Product to Sky-Watch for repair at no additional cost. You can purchase Sky-Watch Care+ when ordering your product or latest 90 days before your existing warranty expires.

    With Sky-Watch extended warranty Care+ your products will be serviced under warranty for 3 years.

  • 2 YEAR SERVICE PLAN

    It is possible to order a 2 year coverage (from date of delivery); comprising 3 factory service/maintenance checks (performed every 8th month), covering:

    • Change of rotor blades,- and rotor arms (motors) if required
    • Checking of internal wiring
    • Factory cleaning of the drone
    • General inspection of the drone condition
    • Written service report

    Freight costs to and from the factory (Denmark) is included. Insurance of the drone during transport is covered by 110 % of the then-current value.
    Return delivery to drone owner is (incoterms 2010) CPT nearest major airport in drone owners’ country. Any import- or export
    taxes and all document costs etc. applied in drone owners’ country are for the account of the drone owner, and will be charged
    locally. Any rendered services not mentioned herein will be charged to the drone owner at applicable rates.
    No additional services will be initiated before written acceptance from drone owner. Expected service/maintenance time is 48
    hours excluding transport time.

  • TRAININGSky-Watch Huginn X1 Rufus Gifford

    At Sky-Watch we offer a two-day training session that will give the operator an in-depth understanding of the operation and
    basic maintenance of the Huginn X1 system. During training Huginn X1 UAVs are made available.

    The session includes lessons in:

    • Configuration setup such as flight boundaries
    • General flight (pilot) lessons
    • General flight flight planning lessons

    After successfully completing the training course you will receive a Sky-Watch Operator certificate.

  • PRODUCT LIABILITY

    Claims for damages and tort for personal injury is in any case limited to the invoice price excl. VAT of the Product.
    For property damage caused by a defect in a delivered Product is the Distributor and/or the Manufacturer solely responsible for the extent it is demonstrated that the harmful defect caused by errors or omissions from the Distributor’s/Manufacturers side or from others that the Distributor/ Manufacturer bears the responsibility for.
    Claims for damages and tort for property damage is in any case limited to the invoice price excl. VAT of the product.
    Not in any event, regardless of the cause, shall the Distributor or the Manufacturer be liable for defective products for any indirect, special, incidental, punitive or consequential damages of any kind, whether arising under breach of these Terms, tort (including negligence), strict liability or otherwise, and whether based on this agreement or otherwise, even if advised of the possibility of such damages.

    GENERAL LIMITATION OF LIABILITY

    The maximum liability to the End-user or third parties on any claim for damages connected with the purchase or use of any of the Products, whether arises in contract, from breach of warranty, in tort or otherwise, is in any case limited to the invoice price excl. VAT of the Product.
    Not in any event, regardless of the cause, shall the Distributor or the Manufacturer be liable for any indirect, special, incidental, punitive or consequential damages of any kind, whether arising under breach of these Terms, tort (including negligence), strict liability or otherwise, and whether based on these Terms or otherwise, even if advised of the possibility of such damages.
    Neither Manufacturer nor the Distributor shall have any liability for damages caused by use of the Products…

    • …in conflict with the User Instruction
    • …in situations where precautions is considered, including but not limited to bad weather such as lightning, rain, snow, strong winds
    • …by children or mentally disabled persons
    • …without proper maintenance
    • …in violation of any, for the Product and its use, applicable laws and regulations.

     

    OPERATOR AND LIABILITY

    As an operator of the Huginn X1 we advise to be insured if anything should happen to you or third party due to lack of operating skills. We refer to the insurance company Marsh LTD for further information regarding the best insurance for your needs. You will have to send an email to Marsh London presenting your Sky-Watch Operator certificate, your Huginn X1 serial number and a description of your flying purposes.

    Marsh LTD also offers a Hull Cover insurance, which covers both theft and accidental incidents.

    Sky-Watch cannot be held responsible in any way for crashes or damages due to lack of operator skills.
